Terms of service.

These Terms of Service (“Terms”) govern your use of the DeliverShot platform (the “Platform”). By creating an account or using the Platform, you agree to these Terms.

The platform and parties

DeliverShot (“we”, “us”) is operated as an unincorporated UK business. You can reach us at privacy@delivershot.com. The Platform helps event photographers (“Photographers”) deliver photos to their event guests (“Guests”) using face-recognition technology.

Data-protection roles

For personal data processed on the Platform:

  • The Photographer is the Data Controller for their event photos, guest lists, and any personal data they collect at their events.
  • DeliverShot acts as a Data Processor, processing personal data on the Photographer’s behalf in accordance with these Terms and our Privacy Policy.

The terms required by Article 28 UK GDPR are set out in our Data Processing Addendum, which forms part of these Terms. It takes effect automatically when you accept these Terms — there is nothing separate to sign. It covers the scope of the processing, our security measures, the sub-processors we use, how we assist you with guest rights requests and breach notification, and what happens to your data when you leave.

Account registration and eligibility

You must be at least 18 years old and operating a legitimate photography business to register as a Photographer. You are responsible for keeping your account credentials secure and for all activity on your account.

Photographer responsibilities

As a Photographer using the Platform, you agree that you are solely responsible for:

  • Registering with the UK Information Commissioner’s Office (ICO) where required, and paying the data-protection fee.
  • Obtaining valid, informed, freely given consent from each Guest before processing their biometric data (selfies) through the Platform’s face-matching features.
  • Obtaining appropriate model releases for commercial use of any event photos where individuals are identifiable.
  • Ensuring that the event photos you upload don’t infringe third-party rights and don’t contain unlawful, defamatory, or offensive content.
  • Providing your own privacy notice to Guests describing how their data is handled at your events, in addition to the Platform’s Privacy Policy.
  • Responding to Guest rights requests (access, rectification, erasure, etc.) as the Data Controller.

Platform fees and payouts

When a Guest purchases photos, Stripe collects the full amount. The Platform charges a fee per transaction; the remainder (including any markup the Photographer has configured) is paid out to the Photographer’s connected Stripe account monthly, on the 1st of the month, covering the previous calendar month’s sales. Exact fees are displayed in your Photographer dashboard and may be updated from time to time with reasonable notice.

You are responsible for your own tax reporting on any income received through the Platform.

Guest purchases: cancellation and refunds

This section applies to Guests who buy printed photos, framed photos, or digital downloads through an event gallery. Most Guests are consumers, and this section explains your rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015. Nothing here takes away your statutory rights.

You buy from DeliverShot — we take the payment, arrange printing and delivery, and issue any refund. The Photographer sets the prices and receives a share of them.

Printed and framed photos

Every print is made to order and personalised to you: it is produced from the photo you chose, in the product and size you chose, and it is not made until you order it. Under regulation 28 of the Consumer Contracts Regulations, made-to-order and personalised goods are exempt from the 14-day right to change your mind. So once your order goes into production you cannot cancel it simply because you no longer want it.

Two things soften that:

  • Before production starts, email us and we will cancel and refund in full if we still can. Production usually begins within a few hours, so contact us quickly — we can’t promise to catch it.
  • If something is wrong with the item, you are always covered. Under the Consumer Rights Act 2015 your print must be of satisfactory quality, fit for purpose, and as described.

If your print arrives damaged, faulty, misprinted, or is not what you ordered, tell us within 30 days of delivery and include a photo of the problem. We will replace it or refund you in full, whichever you prefer, at no cost to you — you will not be asked to post the item back. If an order never arrives, we will reprint it or refund you.

Digital downloads

A digital download is digital content, and the 14-day right to cancel would normally apply until it is supplied. Because you want your photos immediately, we ask you at checkout to confirm two things before payment:

  • That you expressly request we begin supplying the download straight away, without waiting for the 14-day cancellation period to expire; and
  • That you acknowledge you will lose your right to cancel once supply has begun.

You have to give that confirmation to get an instant download. Once you have given it and the download has been made available to you, the 14-day cancellation right no longer applies and the purchase is not refundable on a change of mind. If you would rather keep your cancellation right, don’t buy the download — buy a print, or email us.

This does not affect your rights if the digital content itself is faulty. If the file won’t download, is corrupt, is the wrong photo, or is materially not as described, you are entitled under the Consumer Rights Act 2015 to a working file or a refund. Email us and we will sort it.

Download links are time-limited. If yours expires before you saved the file, email us — while the event gallery is still open we can reissue it.

How to ask for a refund

Email hello@delivershot.com from the address you used at checkout, quoting the order reference on your confirmation email, and describe the problem (with a photo, for a damaged or misprinted item).

We aim to acknowledge within two working days and to decide within five working days. Approved refunds are issued to the original payment method. Your bank or card issuer usually takes a further 5 to 10 working days to show the money in your account — that part is out of our hands.

There is no self-service refund button in the gallery: every refund is reviewed and issued by us.

Acceptable use

You must not use the Platform to upload or process:

  • Images of minors without verifiable parental consent.
  • Non-consensual intimate imagery.
  • Content that infringes copyright or other IP rights.
  • Content that is unlawful under UK law.

We reserve the right to suspend or terminate accounts that violate these rules.

Intellectual property

Photographers retain full ownership of the photos they upload. By using the Platform, you grant us a limited, non-exclusive licence to host, process, and deliver those photos to Guests solely for the purpose of providing the Platform’s services. We don’t claim ownership of your photos and we don’t use them for marketing without your explicit written consent.

Termination

You may close your Photographer account at any time from your settings. We may suspend or terminate accounts that breach these Terms, that are used fraudulently, or where required by law. Upon termination, event photos and associated personal data will be deleted according to the retention periods described in our Privacy Policy.

Referral program

Photographers on a paid subscription may receive a unique referral link. When someone signs up through that link and pays their first subscription invoice, the referring Photographer enters a 60-day probation window. At the end of probation, provided the referee’s payment has not been refunded or disputed, we apply a £10 credit to the referring Photographer’s Stripe customer balance. The credit is consumed automatically against the referrer’s next invoice(s) on a first-in, first-out basis.

Total credit earned through referrals is capped at six (6) times the referrer’s current monthly subscription price. Credits exceeding the cap are voided. If the referee’s qualifying payment is later refunded or disputed, the credit is reversed (deducted from unused balance, or recorded as a reconcilable debt if already consumed). Credits are non-transferable, non-refundable as cash, and carry no expiry while the referrer’s account remains active.

Self-referral (signing up yourself or a connected identity) is not permitted. We reserve the right to modify reward amounts, probation length, and cap multiples, and to void referrals we reasonably believe to be fraudulent or abusive. The program is enabled or disabled at our discretion and may be switched off per-studio or globally at any time.

Disclaimers and limitation of liability

The Platform is provided “as is”. We don’t guarantee that face matching will be 100% accurate, that the Platform will be uninterrupted, or that it will be free from errors. To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the Platform is limited to the fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.

Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

Changes

We may update these Terms from time to time. Material changes will be notified to Photographers by email or through the dashboard. Continued use of the Platform after an update constitutes acceptance of the revised Terms.
